Jackson Township Zoning Department
INTRODUCTION
The power to zone by the township is enacted by the authority granted under the provisions of the Ohio Revised Code (OCR): State of Ohio, Section 519.02. The zoning regulations (Zoning Resolution of Jackson Township, Clermont County, Ohio) were enacted by the Jackson Township Board of Trustees on May 2, 1972. The most recent Zoning Resolution revision was adopted on July 20, 2007.
The Resolution was enacted for the purpose of promoting public health, safety and morels within Jackson Township and for the purpose of promoting the general welfare of the people of Jackson Township.
ZONING ADMINISTRATOR
The Jackson Township Zoning Administrator, appointed by the Township Board of Trustees, is a member of the Jackson Township governmental staff and is the person authorized to administer, interpret and enforce the Zoning Resolution. The Administrator does not have discretionary powers and can only approve applications that conform to the requirements of the Zoning Resolution.

BOARD OF ZONING APPEALS
It is recognized that not every set of circumstances can be covered in the Resolution, nor is every interruption of the Resolution by the Zoning Administrator necessarily correct. That is why the Resolution provides for the Board of Township Trustees to appoint a five member Township Board of Zoning Appeals, a quasi-judicial body of the Township. The Zoning Appeals Board hear and decide appeals where it is alleged there is an error in any order, requirement, decision, or determination made by an administrative official in the enforcement of the Resolution.
This Board may also authorize variances from the terms of the Zoning Resolution where, owning to special conditions, a literal enforcement of the Resolution will result in unnecessary hardship. The Board may also grant conditional zoning certificates for the use of land, buildings, or other structures.

APPLICATIONS FOR A VARIANCE
All questions of interpretation and enforcement is to be first presented to the Zoning Administrator, and that such questions are presented to the Board of Appeals only on appeal from the decision of the Zoning Administrator within twenty (20) days from that decision. Appeals forms may be obtained upon request from the Zoning Administrator. A $200.00 (residential) fee and the completed forms are to be submitted to the Zoning Administrator who will then schedule a hearing with the Board of Zoning Appeals within thirty (30) days of receipt of the form and filing fee.
The Board of Appeals may take up to thirty (30) days to make a finding which must be presented in writing. An appeal to this decision by the Board of Zoning may be made to the Clermont County Court of Common Pleas within thirty (30) days of the date upon that written decision.
