Swimming Pool Ownership In Jackson Township

 

In Jackson Township a private swimming pool is defined as any pool above or below ground, a pond, a lake, or open tank with at least a 1 1/2 foot depth and not located within a completely enclosed structure.  A FARM POND IS NOT INCLUDED IN THIS DEFINITION. A swimming pool is considered an accessory use and must comply with certain conditions and requirements and DOES require a township permit in addition to any applicable county permits.

 

A swimming pool may not constructed or erected closer than 20 feet to any property line and must be behind the residential building set-back line. The depth of an in-ground pool must be clearly marked at each end of the pool, and the depth, in feet, must be marked along the side of the pool for each foot of depth. The pool must be located so that water will not flow onto the property of an adjoining property owner when drained.

 

Swimming pools must be fenced or walled off to prevent uncontrolled access by children from the street or adjacent properties. This fence must be not less than 4 feet in height and must be a minimum of 5 feet from the edge of the pool.  All pool access points are to be provided with a lockable fence gate and, in the case of an above ground pool, a removable or retractable ladder to prevent access to the pool when not in use.

 

Above ground pools with outer pool walls at least 4 feet high are not required to be fenced, however all access points must be locked (or ladders removed) when not in use. If the pool walls are less than 4 feet, the combined height of the pool wall and a fence of some type may be combined to fulfill the requirement.

 

It is important to remember that any pool with a depth more than 1 1/2 feet, including inflatable and self-erected above ground pools, must have a permit and must be fenced and may not be in front of the house or along any roadway, in the event of a corner lot.

 

A farm pond or lake does not require a permit or inspection. However, if it is located less than 75 feet from the right of way, it must be enclosed by a fence at least 4 feet high.
